On March 12, 2024, the Economic Affairs Commission (CAE) of Brazil holds a meeting to regulate the manufacturing, commercialization, inspection, and advertising of electronic cigarettes.
The proposed legislation, PL 5008/2023, seeks to regulate the manufacture, import, export, sale, and consumption of electronic cigarettes. The proposal categorizes electronic cigarettes into two types: electronic nicotine delivery systems (SEAN) and electronic nicotine-free systems. EAN refers to electronic nicotine delivery devices such vaporizers, vapes, pods, mods, electronic cigarettes (e-cigs), cig-a-likes, and others. SESN refers to non-nicotine devices that act similarly to e-cigarettes. These include electronic tobacco heating systems (Seat), such as heat-not-burn devices, and electronic tobacco-free heating systems (Seast), which heat herbal goods instead of tobacco. To acquire approval to manufacture, import, export, and commercialize these items, the company must register with regulatory agencies such as the National Health Surveillance Agency.
