The European Parliament and the Council of the European Union have adopted a draft directive revising key EU water legislation, including the Water Framework Directive (2000/60/EC), Groundwater Protection Directive (2006/118/EC), and Environmental Quality Standards Directive (2008/105/EC). The update introduces new pollutant limits, expands monitoring requirements, and modernizes the EUs water quality framework to address emerging contaminants.
Key Amendments and Proposed Limits
1. PFAS (Per- and Polyfluoroalkyl Substances)
The directive introduces group-based regulation of PFAS, a major shift from substance-by-substance control.
Surface Waters (EQS): Limit set for the sum of 25 PFAS (exact numeric EQS values are specified in annexes of the draft and may differ by water body type; commonly proposed values in legislative drafts are in the low ng/L range, e.g., single- to double-digit ng/L levels for annual average concentrations).
1.Groundwater
Limit for the sum of 20 PFAS aligned with drinking water standards.
Indicative benchmark (aligned with Drinking Water Directive (EU) 2020/2184):0.10 g/L (100 ng/L) for sum of 20 PFAS and 0.50 g/L for total PFAS (broad parameter)
Specific Hazardous PFAS Subset: Additional stricter limits apply to a subgroup of the 4 most hazardous PFAS (values set significantly lower than group limits; typically sub-ng/L to low ng/L range depending on compound).
Notable Substances: Perfluoro octane sulfonic acid (PFOS): already regulated; EQS further tightened (historically ~0.65 ng/L AA-EQS in EU standards).
Trifluoroacetic acid (TFA): included in group limit; no standalone EQS yet but flagged for future restriction.
2. Pharmaceutical Residues (Medicinal Products)
Surface Waters:Newly listed priority substances with very stringent EQS due to endocrine effects:
Ethinylestradiol:Proposed EQS: ~0.035 ng/L (annual average)
Estradiol:Proposed EQS: ~0.4 ng/L
Estriol:Indicative EQS under evaluation (typically higher than estradiol; exact binding value subject to final annex)
Groundwater:Selected pharmaceuticals added with Member Statedefined threshold values based on risk assessment.
Monitoring Approach: Introduction of effect-based trigger values (EBTs) to assess cumulative estrogenic activity rather than relying solely on individual concentration limits.
3. Bisphenol Substances
Immediate Regulation: Bisphenol A designated as a priority hazardous substance:
Proposed EQS: ~0.2 ng/L (annual average) for surface water (extremely low due to endocrine disruption risk)
Watch List / Group Control: Sum of bisphenols introduced for monitoring purposes (no fixed EU-wide numeric limit yet; data collection phase).
Mandatory identification and monitoring of:Bisphenol B, Bisphenol S
National limits may be set at river basin level.
4. Other Emerging Pollutants (Watch List)
Currently monitoring-focused (no binding EU-wide limits yet):
Microplastics harmonized methodologies under development
Antimicrobial Resistance (AMR) indicators surveillance-based thresholds expected in future revisions
System-Level Regulatory Changes
Expanded Chemical Status Definition:
Now includes both EU priority substances and river basin-specific pollutants under a unified framework.
Retention List:Introduced for substances with declining risk but still requiring surveillance.
Standards Alignment:Groundwater PFAS thresholds directly linked to drinking water parametric values.
20-Year Phase-Out Rule:Discharges of priority hazardous substances must be eliminated within 20 years of listing.
