On 15 May 2026, Italian Government published Legislative Decree No. 78 of 8 April 2026 in the Official Gazette, introducing national measures to align Italian legislation with Regulation (EU) 2023/988 on General Product Safety (GPSR). The decree adapts Italy’s regulatory framework to the updated European Union product safety requirements and formally repeals provisions linked to Directive 2001/95/EC on general product safety and Directive 87/357/EEC concerning products posing risks due to misleading appearance. According to the decree, the updated framework strengthens obligations for manufacturers, importers, distributors, and online marketplace operators to ensure that products placed on the market are safe for consumers. The legislation also supports improved market surveillance, product traceability, corrective actions, and consumer information requirements in line with the EU General Product Safety Regulation. The decree further reflects amendments connected to Regulation (EU) No 1025/2012 on European standardisation and Directive (EU) 2020/1828 regarding representative actions for consumer protection. Italy stated that the legislative adaptation aims to enhance consumer safety protection, improve coordination between national authorities and European Union institutions, and ensure consistent enforcement of updated product safety obligations across the Italian market.
