Health Canada has proposed an amendment to the "Table of Permitted Nutrient Content Statements and Claims" to address unintended restrictions on "free of sugars" claims for chewing gum. The previous modification allowed foods meeting "low in energy" criteria (≤40 calories per reference amount) to use the "free of sugars" claim but removed the exemption for chewing gum. Due to chewing gum's low reference amount (3 g), the energy density calculation (based on 50 g) often results in exceeding the 40-calorie threshold, making it ineligible for the claim. The proposed amendment aims to reinstate the exemption for chewing gum, allowing it to use the "free of sugars" claim regardless of energy content. Stakeholders are invited to submit comments by April 2, 2025, to the Food Incorporation by Reference Unit at food.ibr-ipr.aliments@hc-sc.gc.ca, with the subject line "Free of sugars (P-ANC-25-01)."
