On January 9, 2025, the WTO circulated a notification from the Maine Department of Environmental Protection (DEP) regarding the proposal of a new rule, Chapter 90. This rule aims to establish criteria for currently unavoidable uses of intentionally added per- and polyfluoroalkyl substances (PFAS) in products. It also seeks to implement sales prohibitions and notification requirements for products containing intentionally added PFAS that are determined to be a currently unavoidable use under the amended 38 M.R.S. 1614. The deadline for submitting comments on the proposed rule is January 28, 2025.
